Welcome to Clayhall Properties Limited (hereinafter referred to as “We,” “Us,” “Our,” “Landlord,” or “Clayhall”). These Terms and Conditions (“Terms”) govern your use of our website and services(“ the Platform”), including but not limited to browsing available properties and listings, engaging in rental transactions and facilities management. These Terms contained herein on this website constitute a legally binding agreement between you (“You,” “User,” or “Tenant”) and Us.  By accessing or using our Platform, you agree you have read, understood and agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

 

This Agreement apply in full force and affect your use of the Platform and by using any of our Services, you expressly accept all the terms and conditions contained herein in full without limitation or qualification, including our Privacy Policy.

 

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.

 

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted.

 

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

In these Terms, the following words shall have the meanings ascribed to them:

 

  • Landlord: The property owner listing properties for lease on the Platform.
  • Tenant: The individual or entity interested in leasing a property via the Platform.
  • Listing: A property advertised for rent/ lease on the Platform by the Landlord.
  • Platform: The website and associated services provided by Clayhall Properties Limited.

 

  1. Acceptance of Terms

 

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by and in accordance with these Terms. You also acknowledge and agree that you are solely responsible for understanding and complying with all laws, rules, regulations and requirements that may apply to your use of this Platform. We reserve the right to modify, update, or change these Terms at any time without prior notice. Any changes will be posted on this page, and your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

 

  1. User Registration

 

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

 

  1. Eligibility

 

By using this platform or booking an appointment with us, you warrant and represent that:

 

  • You are of age and an individual, a legal person, an organisation and you have the legal capacity and sufficient authorisation to enter into these Terms.

 

  • As an employee or agent of a legal entity, you enter into these terms on their behalf. You also warrant that you have all the necessary rights and authorisations to bind such a legal entity.

 

  • Your use of the Platform will not violate any laws and regulations applicable to you, including but not limited to anti-money laundering and financing terrorism activities.

 

 

  1. Service Use and Prohibited Activities

 

Use of this Platform includes but is not limited to leasing, renting, shortlet services, property development and facilities management. You undertake to use this service as permitted only by Law. You are prohibited from undertaking the following;

  • Attempting to gain unauthorised access to the Platform, transmitting or uploading any material to the Platform that contains viruses, trojan horses, malware, or any other harmful viruses or programmes.
  • methodically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.
  • circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
  • engage in unauthorized framing of or linking to the Site.
  • engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.
  • use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.
  • Misusing and exploiting any portion of this Platform.
  • Using the Platform to damage the server and impair the use of the service by other Users.
  • Carry out illegal and prohibited activity in violation of copyright laws, any regulation, statute or law in Nigeria.
  • Undertaking, facilitating or supporting criminal activity of any kind, including but not limited to terrorism financing and money laundering, and or transactions facilitating illegal activity, stolen funds or the proceeds of crime.
  • Make any alterations that may interfere with the service provided.
  • Intellectual property infringement .

 

We hereby reserve the right to terminate, suspend or restrict your access to the Platform if you undertake any of the above prohibited activities or any similar or related activity.

 

  1. Renting Process

 

  • Tenancy Agreement

 

Once a potential Tenant expresses interest in a property, the Landlord will send the Tenant a tenancy agreement after the necessary due diligence has been carried out.

 

  • Payment Terms

 

Payments, including rental deposits and rent, are handled directly between the Landlord and Tenant, and are not processed through third-party payment providers. A potential Tenant is prohibited from paying rent or rental deposit into the personal account of anyone, an employee of the company, or an agent. The Landlord takes no liability for any rent paid into an account that is not the Landlord’s account.
